VOLUNTEER WITH DALLAS TRINITY FC!

RELEASE OF LIABILITY, WAIVER OF CLAIMS, INDEMNIFICATION, AND ARBITRATION AGREEMENT
DALLAS TRINITY FC – VOLUNTEER WAIVER

NOTICE: By signing this document you may be waiving certain legal rights, including the right to sue. If you are uncertain of your rights or obligations under this agreement, you may wish to consult an attorney.

In consideration of being allowed to serve as a volunteer at any matches, training events, fan engagements, community appearances, watch parties, or other activities hosted or supported by Dallas Trinity FC (collectively, the “Programs”), taking place at the Cotton Bowl or other venues throughout Dallas, Texas, under the control of the team and its affiliates (collectively, the “Organization”), the undersigned individual (the “Volunteer”), and the Volunteer’s parent(s) or legal guardian(s) if the Volunteer is a minor, agree to the following, to the fullest extent permitted by law:

1) WAIVER OF CLAIMS:
To waive any and all claims that they have or may have against Dallas Trinity FC, its ownership group, sponsors, event partners, staff, affiliates, officers, directors, shareholders, employees, agents, volunteers, venue owners (including the Cotton Bowl and other event locations), and other participants (collectively, the “Releasees”) arising out of their volunteer service in the Programs and/or use of any equipment or facilities. This includes claims resulting from any negligence or breach of contract by the Organization or Releasees.

2) ASSUMPTION OF RISK:
To fully assume all risks associated with volunteering in the Programs, including but not limited to physical injury, illness, property damage, or death, whether anticipated or unanticipated, and whether caused by the negligence or breach of contract of the Organization or Releasees.

3) RELEASE OF LIABILITY:
To release the Organization and Releasees from all liability for any loss, damage, injury, death, or expense that the Volunteer (or their next of kin or representatives) may suffer in connection with their role as a volunteer or use of any related facilities or equipment.

4) INDEMNIFICATION:
To indemnify and hold harmless the Organization and Releasees from any claims, losses, liabilities, or costs (including attorneys’ fees) arising from the Volunteer’s participation in the Programs.

5) USE OF IMAGE AND NAME:
To allow the Volunteer’s name, likeness, image, voice, and/or photographs (including those of minor volunteers) to be used by Dallas Trinity FC and its affiliates in promotional materials, broadcasts, social media, and websites. The Volunteer waives all potential claims related to the use of such information, including any under the Children’s Online Privacy Protection Act (COPPA) or similar regulations.

6) ARBITRATION:
Any dispute arising from volunteer involvement in the Programs shall be submitted to binding arbitration through the American Arbitration Association (“AAA”). Each party shall bear its own costs. Arbitration must be initiated within one (1) year from the date a claim arises, will take place in Dallas County, Texas, and will follow the Federal Rules of Evidence. Any arbitration award may be enforced by a court of competent jurisdiction.

7) COMPLIANCE WITH RULES:
Volunteer agrees to follow all rules, guidelines, and safety protocols established by Dallas Trinity FC and its partners and to act responsibly to minimize risk of injury or disruption.

8) REPORTING HAZARDS:
If the Volunteer observes any unsafe condition or unusual hazard during the Programs, they agree to remove themselves from participation and immediately report the issue to an event official or staff member.

9) ENTIRE AGREEMENT:
This document represents the entire agreement and understanding between the parties regarding volunteer service in the Programs and supersedes all prior agreements, whether oral, written, or implied.

10) SEVERABILITY:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11) BINDING EFFECT:
This Agreement is binding upon the Volunteer, their heirs, next of kin, executors, administrators, legal representatives, and assigns.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I ACKNOWLEDGE THAT BY SIGNING, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

Parent or Legal Guardian signature is required if Volunteer is under 18.
